ReefCam Rental: Terms and Conditions, Rental Agreement, Cancellation Policy and Liability Release

1. Terms and Conditions

1.1 Who we are. These Terms apply to every booking with ReefCam Rental ("we", "us"), Kralendijk, Bonaire, for the rental of action cameras (Insta360 Ace Pro 2 and GoPro Hero), dive housings and accessories (the "Equipment"). "You" or "the Renter" means the person who makes the booking.

1.2 Acceptance. By completing a booking, paid online or with "Pay later", you confirm that you have read and accept these Terms, the Rental Agreement (Section 2), the Cancellation Policy (Section 3) and the Liability Release (Section 4). They apply to everyone in your group who uses the Equipment, and you are responsible for their use of it.

1.3 Booking and payment. You either pay the full amount online by card or PayPal, or choose "Pay later" and pay at delivery in cash (USD), Revolut, Wise or Bitcoin. A booking is confirmed once we accept it. Prices are in US dollars and include all fees shown at checkout.

1.4 Delivery and pickup. Delivery and pickup are free anywhere on Bonaire, including hotels, vacation rentals, the airport and the cruise pier. We agree times with you by WhatsApp, email or text. Please reply to scheduling messages promptly. If you are not at the agreed place and time and we cannot reach you, we may treat the booking as a no-show under Section 3.

1.5 Security deposit. A refundable deposit of $250 is collected at delivery in cash (USD), Revolut, Wise or Bitcoin. After the Equipment is returned and checked, cash deposits are returned at pickup and other methods within 3 business days, minus any amounts under Section 2.10.

1.6 Optional extras. Loss Damage Waiver ($5 per rental day, per camera) The waiver is charged per camera. If you rent more than one camera, the waiver for each extra camera is charged at delivery. Keep the SD card ($40) and Footage transfer link ($20). Extras can be added at checkout or later by message, before pickup.

1.7 Age and identity. You must be 18 or older. We may ask to see a photo ID at delivery and note your name and accommodation. We may refuse to hand over Equipment if you cannot show ID or if the Equipment would clearly be used unsafely.

1.8 Communication. Messages by WhatsApp and email count as written communication for these Terms.

2. Rental Agreement

2.1 Equipment. Depending on your booking, for each camera booked: one Insta360 Ace Pro 2 or one GoPro Hero 12 or 13, a dive housing rated to 60 m / 197 ft with anti-fog inserts, a MicroSD card, two batteries, a floating hand grip, a charging cable, a carry case and a quick-start card.

2.2 Condition at handover. We hand over the Equipment clean, charged and working. Please check it when you receive it. If you notice a problem, report it within 24 hours. Otherwise the Equipment is taken to have been in good condition at delivery.

2.3 Use. You agree to:
(a) use the Equipment carefully and only as intended, following the quick-start card;
(b) check that the housing seal is clean and the housing is fully closed and latched before every water entry;
(c) not go deeper than 60 m / 197 ft;
(d) rinse the closed housing in fresh water after salt water use and keep the Equipment out of prolonged sun and heat;
(e) not lend, sublet or give the Equipment to anyone outside your group, and not take it off Bonaire;
(f) not use the Equipment for anything illegal, including filming people where they may expect privacy without their consent;
(g) follow the rules of the Bonaire National Marine Park and not touch, stand on or damage coral or disturb marine life to get footage;
(h) not open or repair the Equipment yourself, other than opening the housing and changing batteries or the card.

2.4 Not a dive operator. We rent camera equipment only. We do not provide dive or snorkel instruction, supervision, guiding or safety advice. You are responsible for diving or snorkeling within your own training, fitness and local conditions.

2.5 Reporting damage, loss or theft. Tell us on WhatsApp within 24 hours of any damage, loss or malfunction. In case of theft, report it to the police (KPCN) and give us a copy of the report.

2.6 Your responsibility. From delivery until pickup you are responsible for the Equipment. Unless the Loss Damage Waiver covers it (2.7), you pay for repair or replacement of Equipment that is lost, stolen or damaged beyond normal wear, including water damage from a flooded housing, for any reason. Repair costs are based on the actual repair invoice; replacement costs use the schedule in 2.8.

2.7 Loss Damage Waiver (optional, $5 per rental day per camera). If you bought the waiver, you pay nothing for accidental damage to the Equipment during your rental. The waiver does not cover:
(a) loss or theft of the Equipment or any part of it;
(b) water damage to the camera or any other Equipment caused by water getting into the housing (flooding), for any reason, including a seal that was not clean, a housing that was not fully closed or latched, or a cracked housing;
(c) damage caused on purpose, by gross negligence or by using the Equipment against 2.3 (for example, leaving it in a hot car, exceeding 60 m / 197 ft, or using it after it was clearly damaged);
(d) damage that was not reported under 2.5 before pickup.
In those cases 2.6 applies in full, even if you bought the waiver.

2.8 Replacement price schedule. 

Insta360 Ace Pro 2 camera: $450

GoPro Hero 12 / 13 camera: $400

Dive housing: $60

Battery: $35

MicroSD card: $40

Floating hand grip: $20

Charging cable: $5

Carry case: $25

Laminated quick-start card: $5

The total you pay under 2.6 never exceeds the full replacement value of the rented kit.

2.9 Return and late return. You make the Equipment available for pickup at the agreed time and place, complete and in the same condition, apart from normal wear. If it is not available on time, we charge the normal daily rate for each extra day or part of a day. If you do not return it and do not respond to us for 48 hours after the agreed pickup, we may treat the Equipment as lost under 2.6 and report it to the police.

2.10 Deposit deductions and payment of extra costs. We may deduct from your deposit: repair or replacement costs under 2.6 and 2.8, missing accessories, late fees under 2.9 and any unpaid rental or extras. We will send you a short explanation and photos of any damage. Costs above the deposit are payable within 14 days of our invoice. If you paid online and costs remain unpaid, you authorize us to charge them through the same payment method where the payment provider allows it.

2.11 Malfunction. If the Equipment stops working through no fault of yours, tell us straight away. We will replace it if we have a camera available, or refund the rental fee for the days you could not use it. This is our full responsibility for a malfunction.

2.12 SD card, footage and privacy.
(a) Unless you chose Keep the SD card, the card is part of the Equipment and must be returned.
(b) After pickup, cards are wiped for the next renter. Unless you chose the Transfer link, we cannot provide or recover footage after that. Please save your footage before pickup.
(c) If you chose the Transfer link, we copy your footage only to create the link. The link and our copy are deleted after 30 days.
(d) We do not view your footage beyond what is needed for the transfer, and we never publish or share it without your written permission.
(e) We collect only the personal details needed for your booking (name, contact details, accommodation, payment and deposit details, signed documents). We use them to run your rental, and share them only with the providers we use for bookings, payments and our website, or when the law requires it. We keep booking records as long as required for accounting. You can ask us to see or delete your details at info@reefcamrental.com.

2.13 Limitation of our liability. As far as the law allows:
(a) our total liability to you for anything related to a rental is limited to the rental fee you paid for that booking;
(b) we are not liable for lost or damaged footage, missed moments, missed dives, travel costs, or other indirect or consequential loss;
(c) we are not liable for damage to your own devices, cards or gear used with our Equipment.
Nothing in these Terms limits our liability for intent or gross negligence of ReefCam Rental, or where the law does not allow it to be limited.

2.14 Force majeure. Neither of us is responsible for failing to perform because of events outside reasonable control, such as hurricanes and tropical storms, port or airport closures, government measures, or power and network failures. In that case we will offer new dates first; if that is not possible, you receive a refund of amounts paid online for days you could not use the Equipment. Normal weather and sea conditions, or a cancelled dive trip, are not force majeure; Section 3 applies.

3. Cancellation Policy

3.1 7 or more days before the rental start: full refund of amounts paid online.
3.2 48 hours to 6 days before: 50% refund of amounts paid online.
3.3 Less than 48 hours before, or no-show: no refund. For Pay later bookings, a cancellation within 48 hours or a no-show may be charged at 50% of the rental price.
3.4 Free date change: once per booking, if requested more than 48 hours before the original start date and subject to availability.
3.5 Ending early: no refund for unused days, unless 2.11 applies.
3.6 Our cancellation: if we cannot provide a confirmed booking, you receive a full refund of amounts paid online. We are not liable for other costs.
3.7 How to cancel: by WhatsApp or email to info@reefcamrental.com. The time we receive your message counts.
3.8 Refunds go back to the original payment method, usually within 5 to 10 business days depending on the provider. The deposit is separate from this policy.

4. Liability Release, Assumption of Risk and Indemnity

Please read this carefully. By signing or accepting it, you give up certain rights.

4.1 Assumption of risk. I understand that snorkeling, freediving, scuba diving, swimming, boating and other water and beach activities carry risks, including drowning, decompression illness, barotrauma, injury from marine life, coral, currents, waves, boats and rocks, sunburn and heat illness, and that using a camera can distract me from my surroundings, buoyancy and buddy. I choose to take part in these activities of my own free will and accept these risks.

4.2 My own judgment. I confirm that I will only take part in activities that fit my training, certification, health and experience, and the conditions on the day. I will not let filming take priority over safe diving or swimming. I understand that ReefCam Rental does not supervise, instruct or guide me, and does not check my fitness or qualifications.

4.3 Release. To the fullest extent the law allows, I release ReefCam Rental, its owner and helpers from all claims for personal injury, illness, death, or loss or damage to property that arise from my participation in water or other activities while using the Equipment, except where caused by the intent or gross negligence of ReefCam Rental, or where the law does not allow such a release.

4.4 Indemnity. I will compensate ReefCam Rental for claims, fines and costs brought against it by third parties (including other people and authorities) because of how I or my group used the Equipment, such as filming people without consent, breaking marine park rules, or damage to property of others.

4.5 Minors and my group. If anyone under 18 or anyone else in my group uses the Equipment, I am responsible for supervising them and I accept this release on their behalf as far as the law allows.

4.6 Electronic signature. I agree that accepting this document online, by checkbox or electronic signature, is as binding as a handwritten signature.

5. General

5.1 Governing law. These Terms are governed by the law of the Caribbean Netherlands, including the Civil Code BES.
5.2 Disputes. We will first try to solve any issue with you directly. If that fails, the Court of First Instance of Bonaire (Gerecht in eerste aanleg van Bonaire, Sint Eustatius en Saba) has jurisdiction, unless the law gives you the right to go to another court.
5.3 Severability. If any part of these Terms is found invalid, the rest stays in force, and the invalid part is replaced by a valid clause that comes as close as possible to its purpose.
5.4 Entire agreement and language. These Terms, your booking confirmation and any signed documents are the full agreement between us. If we publish translations, the English version applies in case of differences.
5.5 Changes. The version of these Terms that applied when you booked governs your booking.
